PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

Banya Boat is a dockside floating sauna and wellness facility located within a marina on Lake Union. Banya Boat remains secured at the dock during guest use and does not operate underway.

By entering or using Banya Boat, I acknowledge that I have read, understand, and agree to the following terms.

Swimming, jumping, diving, plunging, or intentionally entering Lake Union from Banya Boat, any dock, float, walkway, or marina area is STRICTLY PROHIBITED.

Marina water may contain serious visible and hidden hazards, including:

• Shore-power electrical systems and possible stray electrical current
• Old pilings and submerged structures
• Vessel traffic and propellers
• Lines, anchors, debris, sharp objects, and underwater obstructions
• Deep and cold water

Entering marina water may result in electric shock, electrocution, entanglement, collision, cold shock, drowning, catastrophic injury, or death.

Guests must use only the designated Banya Boat cold plunge, showers, cold bucket, hot tub, sauna, and steam facilities.

Any intentional lake entry or attempt to jump or dive from Banya Boat or the marina may result in immediate removal without refund.

If someone accidentally falls into the water, guests must immediately notify Banya Boat staff and follow emergency instructions.

Banya Boat is located within a quiet residential marina community.

This is a wellness environment, not a party boat.

Guests must:

• Keep voices and music at respectful levels
• Walk carefully and quietly through the marina
• Avoid running, yelling, horseplay, fighting, or dangerous behavior
• Never climb, sit, stand, or jump from railings, roofs, barriers, or restricted areas
• Respect neighboring residents, vessels, docks, property, staff, and other guests
• Follow all posted rules and instructions from Banya Boat staff and marina personnel

Unsafe, disruptive, threatening, destructive, excessively loud, or disrespectful conduct may result in immediate removal without refund.

Banya Boat includes a high-temperature sauna, steam sauna, hot tub, cold plunge, showers, and rapid hot-to-cold exposure.

I understand that these activities may involve risks including:

Burns • dehydration • overheating • dizziness • fainting • cold shock • blood-pressure changes • cardiovascular stress • loss of balance • falls • loss of consciousness • serious injury • death

I agree to use all facilities responsibly, remain hydrated, recognize my physical limits, and stop immediately if I feel unwell.

I am responsible for determining whether I am medically and physically able to participate.

I will not participate if I know or reasonably believe that a medical condition, pregnancy, medication, heart or blood-pressure condition, seizure history, respiratory condition, illness, injury, impaired heat or cold tolerance, or other circumstance makes participation unsafe.

If I am uncertain, I will consult a qualified medical professional before participating.

Banya Boat staff are not responsible for determining my medical fitness.

Guests may not use Banya Boat facilities while dangerously impaired by alcohol, cannabis, illegal drugs, medications, or any substance that affects judgment, balance, coordination, consciousness, or the ability to follow safety instructions.

Banya Boat may refuse entry or terminate participation when staff reasonably believes a guest is too impaired to participate safely.

Removal for impairment or unsafe conduct is without refund.

I understand that Banya Boat is a floating structure secured within a marina.

Although Banya Boat remains docked during guest use, the vessel and surrounding docks may move due to wind, waves, wakes from passing vessels, water conditions, weather, or movement of guests.

Decks, docks, stairs, showers, sauna areas, hot-tub areas, and other surfaces may become wet or slippery.

I agree to walk carefully, use handrails where available, and follow all posted safety instructions.

No person under 18 years of age is permitted aboard Banya Boat or may participate in any reservation or activity.

Guests may be required to provide valid government-issued identification.

Guests arriving with a minor may be denied entry or have the reservation terminated without refund.

Pets and animals are not permitted aboard Banya Boat.

Guests arriving with a prohibited animal may be denied entry or have the reservation terminated without refund.

Nothing in this provision is intended to restrict an accommodation required by applicable law for a qualified service animal.

Guests are responsible for their own phones, jewelry, watches, clothing, electronics, and other personal belongings.

Heat, steam, moisture, and water may damage personal property.

To the fullest extent permitted by law, Banya Boat is not responsible for loss, theft, or damage to personal property.

I voluntarily choose to participate in Banya Boat activities.

I understand and knowingly assume the inherent and reasonably foreseeable risks associated with:

• Sauna and steam exposure
• Hot-tub and cold-plunge use
• Rapid temperature changes
• Wet and slippery surfaces
• Stairs and docks
• Floating structures and normal vessel movement
• Proximity to Lake Union
• Weather, waves, and wakes
• Other activities described in this Agreement

I understand that serious injury or death is possible despite reasonable safety precautions.

To the fullest extent permitted by Washington law, I release and hold harmless Banya Boat, its owning and operating entities, owners, members, managers, employees, contractors, agents, representatives, and affiliates from claims, damages, losses, liabilities, or expenses arising from:

• My voluntary participation
• Risks I have knowingly assumed
• My use or misuse of the facilities
• My failure to follow this Agreement or safety instructions
• My intentional, reckless, or negligent conduct

This release is intended to be as broad as legally permitted.

Nothing in this Agreement waives any right or liability that cannot legally be waived under applicable law.

I am responsible for damage or extraordinary cleaning costs caused by my intentional, reckless, or negligent conduct.

Banya Boat may immediately terminate participation for:

• Entering or attempting to enter marina water
• Unsafe use of facilities
• Dangerous horseplay
• Excessive noise or disruption
• Significant intoxication or impairment
• Fighting, harassment, or threatening behavior
• Property damage
• Entering restricted areas
• Ignoring Banya Boat staff or marina instructions

All payments are final.

If plans change, a reservation may be rescheduled to another available date and time.

Rescheduling is subject to availability.

No refund is provided for:

• No-shows
• Late arrival
• Voluntary early departure
• Personal inability to participate
• Removal for rule violations
• Intoxication or unsafe conduct

By completing a booking, I acknowledge and agree that all payments are final and non-refundable.

Nothing in this policy limits any refund or remedy required by applicable law.

Guests must immediately notify Banya Boat staff of any injury, accidental water entry, medical emergency, fire, damaged equipment, electrical concern, or unsafe condition.

Banya Boat personnel may contact emergency services and provide reasonable assistance when necessary.

By signing below, I acknowledge:

✓ I UNDERSTAND THAT THIS AGREEMENT CONTAINS AN ASSUMPTION OF RISK AND RELEASE OF LIABILITY.

✓ I AM PARTICIPATING VOLUNTARILY.

✓ I AM RESPONSIBLE FOR DETERMINING WHETHER I AM MEDICALLY ABLE TO PARTICIPATE.

✓ I UNDERSTAND THE RISKS ASSOCIATED WITH SAUNA, STEAM, HOT-TUB, COLD-PLUNGE, RAPID TEMPERATURE CHANGES, WET SURFACES, DOCKS, AND A FLOATING FACILITY.

✓ I UNDERSTAND THAT BANYA BOAT REMAINS DOCKED DURING GUEST USE BUT MAY MOVE BECAUSE OF WIND, WAVES, OR WAKES.

✓ I WILL NOT SWIM, JUMP, DIVE, OR INTENTIONALLY ENTER MARINA WATER.

✓ I UNDERSTAND THAT BANYA BOAT IS STRICTLY 18+.

✓ I UNDERSTAND THAT PETS ARE NOT PERMITTED, EXCEPT WHERE ACCOMMODATION IS REQUIRED BY LAW FOR A QUALIFIED SERVICE ANIMAL.

✓ I WILL FOLLOW ALL BANYA BOAT AND MARINA SAFETY RULES AND INSTRUCTIONS.

✓ I UNDERSTAND THAT RULE VIOLATIONS MAY RESULT IN IMMEDIATE REMOVAL WITHOUT REFUND.

✓ I UNDERSTAND THAT ALL BOOKINGS AND PAYMENTS ARE FINAL AND NON-REFUNDABLE AND THAT RESCHEDULING IS SUBJECT TO AVAILABILITY.

✓ I VOLUNTARILY ACCEPT THE TERMS AND RISKS DESCRIBED ABOVE.
